About this property

Cherry Street is an attractive hamlet to the north of Duton Hill lying approximately halfway between the Essex towns of Dunmow and Thaxted. The larger towns of Bishop’s Stortford and Braintree are approximately 8 miles to the southwest and 10 miles to the southeast (as the crow flies). Lot 1 – Marshs (House) - Guide Price £925,000

Marshs is a charming and impressive barn conversion offering considerable space and the option to occupy the property either as one or two separate dwellings. Marshs has driveway parking off Cherry Street and attractive gardens to the side and rear, which are enclosed by fences and extend to 0.17 hectares (0.42 acres in total. On the other side of the driveway to Lot 2 is a further parking area and a paddock, which extends to approximately 0.54 hectares (1.33 acres). In total Lot 1 extends to approximately 0.71 hectares (1.75 acres).

    Lot 2 – Marshs (Buildings) - Guide Price £500,000

The buildings at Marshs (also known as Brick House Farm) occupy an area of approximately 1.36 hectares (3.36 acres) and include the driveway from the buildings to Cherry Street, which passes the house. The buildings are former agricultural buildings which have more recently been used for a variety of commercial purposes. A series of planning applications were made by the vendors seeking to regularise the previous uses, however these have been refused and the vendors are in the process of moving tenants out so that the property can be sold with vacant possession.

The buildings which are in generally reasonable condition are of mixed construction and stand on a gently sloping site. The footprint of each building is shown below with the numbers referring to the plan below.

    Method of sale

The freehold of the property is offered for sale by private treaty as a whole or in two lots.

    Planning

Marshs is Grade II listed (listing reference 1322573) and described as a ‘Five-bay barn....C17 barn, timber framed and weatherboarded with half hipped thatched roof.’ The property falls within the administrative area of Uttlesford District Council (udc) and is not within the Green Belt nor a conservation area. Whilst the original use of the buildings was for agricultural purposes, there has been a more recent history of commercial occupation. A number of recent planning applications to regularise these uses have been refused. Further details are set out in the Local Authority searches, details of which can be found in the Weldon Beesly Property Portal.

    Overage

The vendors consider there is development potential in respect of Lot 2. With the uncertainty surrounding the recent planning history, the guide price has been set at a very conservative level. If offers are received at this level the vendors would expect to include overage provisions in the sale. If offers are received which the vendors consider reflect this development potential, they would be prepared to sell the property without overage provisions. For further information please contact Weldon Beesly.

    Services

Mains water and electricity are available to the property. Drainage is to a private system. The purchaser(s) will be deemed to have full knowledge and satisfied themselves as to the provisions of any such services.

    Tenure and possession

The Property forms part of Land Registry Title number EX670042. The tenants who occupied the buildings have been asked to vacate and it is anticipated that both Lots 1 and 2 will be available with the benefit of vacant possession. The title information is available in the Weldon Beesly Property Portal.

    Exchange of contracts and completion

Contracts to be exchanged within 28 working days of the issue of a draft contract by the Vendor’s solicitor. A 10% deposit will be payable on exchange of contracts with completion on a date to be agreed.

    Anti-money laundering

To comply with the Money Laundering Regulations 2017, once an offer is accepted the Purchaser(s) will be required to provide any information requested in order to undertake the relevant due diligence. This is a legal requirement.

    Easements, covenants, rights of way

The property is sold subject to all existing wayleaves, easements, public or private rights of way, covenants and restrictions, whether stated in these particulars or not.

The Purchaser(s) will be deemed to have full knowledge and satisfied themselves as to the provisions of any such matters affecting the Property.

    Boundaries

The Vendors and the Vendors’ agent will do their best to specify the ownership of boundary hedges, fences and ditches but will not be bound to determine these. The Purchasers will have to satisfy themselves as to the ownership of any boundaries. If the property is sold in two lots, the purchaser(s) of Lot 2 will be required to install and thereafter maintain a post and three rail wooden fence between the points marked A and B on the site plan. A right of way will be granted to the purchaser(s) of Lot 1 over the driveway (between B and C on the plan) to Lot 2, subject to sharing the cost of maintenance, according to use.
